If you or a loved one has been arrested, time is critical. The arrest process includes being taken into custody, booked, and placed in a holding cell before being transferred to a county facility. Once booking is complete, you will be allowed to make a phone call—your first call should be to an experienced criminal defense attorney or someone who can contact one immediately.
Know Your Constitutional Rights
Under the U.S. Constitution, you have the right to remain silent, be free from illegal searches and seizures, and have legal representation. Even if an arrest seems minor, law enforcement may use it as a tactic to question you about a more serious crime. Do not answer questions or discuss your case without an attorney present.
Exercise Your Right to Remain Silent
Speaking to law enforcement without a lawyer can jeopardize your case. Anything you say can be used against you, and attempting to explain your situation may only strengthen the prosecution’s case. Remain silent and request an attorney immediately—this is your best defense.
If you are arrested, stay calm and do not resist, as this can lead to additional charges. You are only required to provide your name and basic identifying information. Do not answer any other questions—simply state, "I am invoking my right to remain silent and want an attorney."
Do not consent to any searches of your home, vehicle, or belongings unless law enforcement has a warrant or legal justification. Politely say, "I do not consent to a search." Even if officers search anyway, your objection may help your defense.
After booking, you will have an opportunity to make a phone call. Your first call should be to an attorney or someone who can retain one for you. At your arraignment, the charges against you will be read, and you will enter a plea—always consult an attorney before making any decisions.
A skilled defense lawyer can challenge the charges, negotiate bail, and build your defense.
